The problem with field sobriety tests

If you have been arrested and charged with a driving under the influence offense in Georgia, you will no doubt want to be learning as much as you can about your options to defend yourself against these charges. Among the things you should investigate are the tests you were asked to participate in before you were arrested. The results of all testing, including the field sobriety test results, are used as evidence to support placing you under arrest.

As explained by, the three tests used by law enforcement are standardized and approved by the National Highway Traffic Safety Administration. That, however, does not mean they are foolproof. In fact, each one of the field sobriety tests has an identified inaccuracy rate. The accuracy rates of the tests range from a low of 65 percent to a high of only 77 percent.

Your physical, mental and emotional health may actually play into your inability to pass one or more of the field sobriety tests. Obesity, for example, may inhibit your ability to balance properly. Anxiety may also contribute to a lack of good balance. Some neurological conditions may negatively impact the results of the horizontal gaze nystagmus test which measures an involuntary jerking motion of the eyeball.
